In the current digital age, where technology is advancing rapidly and the use of the Internet is a necessity at first hand, legal regulation can not be ignored in relation to the management of these systems, since said technological advance has also been used for criminal purposes.
That is why Law 1273 of 2009 penalizes those criminal conducts committed with the aid offered by the digital age are penalized. Acts such as “phishing”, which poses a scam by supplanting the identity of a company or entity of apparent reliability, to obtain confidential information in a fraudulent manner, have their respective criminal sanction.
From a labor and business point of view, this Law also faces employers with the need to create internal policies for their workers, in order to regulate the internal management of information, files, databases and, in general, all information that can be easily manipulated and susceptible to mismanagement in favor of crime.
These crimes are among those that must be processed through the new Abbreviated Criminal Procedure, with the advantages that this entails: shorter duration and faster processing times.
Additionally, on July 24, 2018, the first International Treaty was approved in Colombia to combat cybercrime and cyberdelinquency, so the fight against this type of crime now has an important level of international cooperation.
